SIMI Competition for Secondary School Students

Terms and Conditions

 

 

Promoter and Data Controller:  The Society of the Irish Motor Industry (“SIMI”), 5 Upper Pembroke Street, Dublin 2. No entries should be sent to this address.

By entering this competition each entrant (either directly or through their parent/guardian on their behalf) will be deemed to have accepted, and will be bound by, these terms and conditions and by any other requirements set out in related competition materials. All entry instructions form part of the rules.

 

A. Eligibility to enter / opening and closing dates

1.     The competition is open to secondary school students aged 12 and over resident in the Republic of Ireland, excluding employees of SIMI and their immediate families, affiliates and agents or anyone professionally connected with the competition.

2. Internet access required.

3. The competition will open at 00:00 on 8th April 2024 and the closing date for entries will be 23:59 on 1st May 2024 (the “Closing Date”).

4. One entry per person.

5. The prize is described in Section 10 below (the “Prize”).  An entrant cannot win more than one Prize during the competition.  Only one Prize per secondary school.


B. How to enter and entry requirements

6. To enter, each entrant must submit written answers to seven questions on the subject of motor industry apprenticeships.  The questions must be accessed and answered at https://www.simi.ie/en/schools-competition.

7. Each entry submitted by an entrant:
a. must not be obscene or indecent;
b. must not contain defamatory statements or words or symbols that are offensive;
c. must not include threats to any person, place, business or group;
d. must not invade privacy, data protection or other rights of any person, or rights of any firm or entity;
e. must not in any other way violate applicable laws and regulations or network standards;
f. must not contain or refer to any products or services other than those of SIMI and it must not contain or reference any third party trademarks, logos or other intellectual property (other than those of SIMI) unless such inclusion is merely incidental and is not unduly prominent and as long as it is included with due cause and in such a way that it does not take unfair advantage or any third party intellectual property; and
g. must not contain any copyrighted works (other than those owned by the entrant).

8. Entries from agents, third parties, organised groups, syndicates or those made using methods such as a computer macro, a script or the use of automated devices or processes are not allowed and all such entries will be disqualified. No incomplete or corrupted entries, or multiple entries from the same person, will be accepted.

 

C. The Prize

9. There will be three winners.

10. Each winner will receive one Prize, comprising:
a. A voucher from Calnet IT Solutions Ltd in the sum of €1,000 on behalf of and for the use of the winner’s secondary school at its sole discretion; and
b. one set of Beats Studio Buds Active noise cancelling headphones for the winner’s own use.

11. The Prize is non-exchangeable, non-transferable and non-refundable and no cash alternative will be available in any circumstances.

12. In the event of unforeseen circumstances, SIMI reserves the right to substitute the Prize for an alternative of equal or greater value, such value to be determined by SIMI in its sole discretion.

 

D. Selecting winners

13. Each winner will be selected by a panel of judges, at least one member of which will be independent from SIMI.  The winners will be chosen within 14 days of the Closing Date.

14. Each entry will be judged by the panel of judges based on relevance, originality and creativity.

15. Each winner will win the Prize described in Section 10(a) and (b) above.

16. The decisions of the panel of judges are final.

 

E. Notification to each winner and delivery of the Prize

17. Each winner will be notified within 14 days of the judging date (subject to verification) via the email address/telephone number they provided when submitting their entry.  Each winner will be required to provide SIMI with their full name and the name and address of their school, and specify the year they are in, to facilitate delivery of the prize.

18. SIMI will make all reasonable effort to contact each winner. If the prize is not claimed after 7 days of the first attempt to contact the winner, it will lapse and SIMI reserves the right to offer the unclaimed prize to a substitute winner in accordance with these terms and conditions.

19. The Prize will be delivered to the postal address provided by the winner via a recorded delivery service no later than 6 weeks after the Closing Date.  SIMI accepts no responsibility for failed delivery due to the provision of incorrect contact details by the winner.  Any prize that is returned undelivered will be assumed unwanted.

20. The winners’ details (names and counties) will be made available in response to requests submitted within 10 weeks of the Closing Date by post to The Society of the Irish Motor Industry, 5 Upper Pembroke Street, Dublin 2, or by email to competitions@simi.ie

 

F. General information

21. Winners may be required to submit valid identification before receiving the prize.

22. Each winner must be able to accept the prize as set out and in accordance with these terms and conditions.  In the event they are unable to do so then SIMI reserves the right to award the prize to an alternative winner at its own discretion.

23. By entering the competition each entrant will be deemed to have agreed to the transfer of their personal data to SIMI for the purposes of the administration of the competition in accordance with these terms and conditions.  With the exception of personal data retained for the purpose of Section 24 all personal data will be deleted once the competition has concluded.  For more information about how SIMI uses and protects the personal data it handles, please see SIMI’s data protection statement (available at www.simi.ie/en/privacy-statement).

24. Winners and their schools may be required to take part in unpaid publicity arising from this competition and by participating in the competition, they agree to do so.

25. By entering the competition, each entrant hereby represents and warrants that they have not acted in any manner that could be deemed to be detrimental to the brand of SIMI or any of its subsidiaries or related entities.

26. Incomplete entries or those not in accordance with the entry instructions will not be accepted and SIMI reserves the right to remove, edit or disqualify any entry, at its sole discretion, if, for any reason, it is believed to be altered, illegible, inappropriate or unsuitable.

27. The entry shall be the entrant’s own work and by entering the competition each entrant warrants that their entry shall not have been previously published or exploited in any part and will not infringe any copyright, right of privacy, right of publicity or personality or any other right whatsoever of any third party.  If an entrant submits an entry that includes materials, the rights in which are owned by a third party (including intellectual property rights such as copyright and trademarks), the entrant will be responsible for any legal action that third party may take in respect of such materials.

28. All entries will become the property of the SIMI on receipt and will not returned.  By submitting their entry each entrant agrees to assign to SIMI all of their intellectual property rights with full title guarantee and waive all moral rights in and to the entry and otherwise arising in connection with the entry to which the entrant may now or at any time in the future be entitled.

29. SIMI does not warrant that any use of or access to online services will be uninterrupted by error or virus free nor will it have any liability for damage caused by hostile software which may infect entrants’ equipment or property as a result of entrants using or browsing the services.  SIMI will not be liable for technical, hardware or software failures of any kind or lost or unavailable network connections that may limit or prohibit an entrant’s ability to participate in the competition.

30. To the extent permissible by law, SIMI will not be liable for any loss, damage or consequential damage of any nature whether in contract, tort (including negligence) or otherwise arising out of the entrant’s participation in the competition, acceptance of these term and conditions or in connection with the prize.

31. SIMI reserves the right at any time to cancel, modify or supersede the competition (including altering prizes) if, at its sole discretion, the competition is not capable of being conducted as specified.

32. If there is any reason to believe that there has been a breach of these terms and conditions SIMI may, at any time and at its sole discretion, refuse to accept, exclude or disqualify any entry without notice.

33. SIMI will be the final arbiter in any disputes pertaining to the competition and its decisions will be final and binding and no correspondence will be entered into.

34. SIMI reserves the right to amend these terms and conditions without notice to entrants. Any amendments will be published on the SIMI’s website at www.simi.ie

35. These terms and conditions shall be governed by Irish law and the courts of Ireland shall have exclusive jurisdiction.
